Welcome to Survival of Races!

These terms and conditions outline the rules and regulations for the use of Survival of Races, located at www.survivalofraces.com, and the Survival of Races game client (desktop and mobile applications).

By accessing this website or using the game client, you accept these terms and conditions in full. Do not continue to use Survival of Races if you do not agree to all of the terms and conditions stated on this page.

Definitions: “Client”, “You” and “Your” refers to you, the user of this website and/or game client. “The Company”, “We”, “Our” and “Us” refers to Survival of Races and its developer, Sergio Terrazas. “Service” refers to the website, game client, and game servers collectively.

Account Registration & Google Sign-In

Account Creation

To play Survival of Races, you must create an account using Google Sign-In. By signing in with Google, you authorize us to access your email address, display name, and profile picture URL for authentication purposes as described in our Privacy Policy.

Google API Services

Our use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. Specifically:

  • We only request access to the Google user data necessary for authentication (openid, email, profile scopes)
  • We use Google user data solely for providing and improving the authentication functionality of our Service
  • We do not transfer Google user data to third parties except as necessary to provide the Service, comply with applicable law, or as part of a merger/acquisition with adequate data protection
  • We do not use Google user data for serving advertisements
  • We do not allow humans to read Google user data unless we have your explicit consent, it is necessary for security purposes, to comply with applicable law, or the data is aggregated and anonymized for internal operations

Account Responsibilities

  • You are responsible for maintaining the security of your Google account used to sign in
  • You must not share your account or allow others to access the Service through your credentials
  • You must not create multiple accounts to circumvent bans, restrictions, or game rules
  • You must be at least 13 years of age to create an account

Game Rules & Conduct

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use cheats, exploits, automation software, bots, or any unauthorized third-party tools
  • Interfere with or disrupt the Service, servers, or networks connected to the Service
  • Attempt to gain unauthorized access to any part of the Service or other users’ accounts
  • Harass, abuse, or harm other players
  • Impersonate any person or entity
  • Engage in any activity that could damage, disable, or impair the Service

Virtual Items

All in-game items, resources, currencies, and progress are virtual and belong to us. You have a limited, non-transferable license to use them within the game. Virtual items have no real-world monetary value and cannot be exchanged for real currency.

Intellectual Property

Unless otherwise stated, Sergio Terrazas owns the intellectual property rights for all material on Survival of Races, including but not limited to game assets, code, designs, text, graphics, logos, and sounds. All intellectual property rights are reserved.

You may not:

  • Republish material from Survival of Races
  • Sell, rent, or sub-license material from Survival of Races
  • Reproduce, duplicate, or copy material from Survival of Races
  • Redistribute content from Survival of Races

User-Generated Content

If the Service allows you to post, submit, or share content (such as chat messages, forum posts, or comments):

  • You grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display your content within the Service
  • You warrant that your content does not infringe any third-party rights and does not contain defamatory, offensive, or unlawful material
  • We reserve the right to remove any content that violates these Terms without prior notice

Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your data, including data obtained through Google authentication.

Service Availability

  • We strive to keep the Service available but do not guarantee uninterrupted access

  • We are not liable for any loss or inconvenience caused by downtime or service changes

Account Termination

  • You engage in cheating, exploiting, or abusive behavior
  • Your account is involved in fraudulent activity

Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided “as is” and “as available” without warranties of any kind
  • We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service
  • Our total liability for any claim related to the Service shall not exceed the amount you have paid us in the 12 months prior to the claim (if any)
  • As long as the Service is provided free of charge, we will not be liable for any loss or damage of any nature

Nothing in these Terms will:

  • Limit or exclude liability for death or personal injury caused by negligence
  • Limit or exclude liability for fraud or fraudulent misrepresentation
  • Limit any liability in any way that is not permitted under applicable law

We reserve the right to amend these Terms & Conditions at any time. Changes will be posted on this page with an updated date. By continuing to use the Service after changes are posted, you agree to the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law provisions.
